1. Overview

This website is operated by Nonnegotiable Flow, an Australian partnership with ABN 51 152 300 379.

Throughout these Terms, “Nonnegotiable Flow”, “we”, “us” and “our” refer to the business operating this website. Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer and sell our products.

These Terms apply when you visit our website, create an account, submit information or purchase products from us.

By using our website, you agree to these Terms and our:

If you do not agree to these Terms, you should not use our website.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

2. Eligibility and accounts

You must be at least 18 years old, or have permission from a parent or legal guardian, to place an order through our website.

You agree that the information you provide to us is accurate, current and complete.

If you create an account, you are responsible for maintaining the security of your login information and for activity conducted through your account. Contact us promptly if you believe your account has been accessed without permission.

We may suspend an account if we reasonably believe it is being used fraudulently, unlawfully or in breach of these Terms.

3. Product information

We make reasonable efforts to ensure product descriptions, photographs, colours, measurements and other information are accurate.

Colours and appearance may vary slightly depending on lighting, photography and device-display settings. These reasonable variations do not affect your rights if a product is faulty, materially different from its description or otherwise fails to meet a consumer guarantee.

Sizing can differ between garments and fits. Customers should review the measurements and fit information provided on each product page before ordering.

We may update product descriptions, specifications and availability before an order is accepted.

4. Product availability

Products may be available in limited quantities and can sell out without notice.

Adding an item to your cart does not reserve it. A product is not secured until your order has been accepted.

We may limit quantities where reasonably necessary, including to prevent suspected fraud, unauthorised resale or purchasing activity that disrupts fair access to limited products.

Discontinued or limited-release products might not be restocked.

5. Orders and acceptance

Submitting an order is an offer to purchase the selected products.

An automated order-confirmation email acknowledges that we received your order but does not necessarily mean the order has been accepted. We accept your order when we confirm it for fulfilment or dispatch.

We may decline or cancel an order before acceptance if:

• A product is unavailable

• There is an obvious pricing or product-information error

• Payment cannot be authorised

• Shipping information is incomplete or invalid

• We reasonably suspect fraud, unauthorised resale or unlawful activity

• We cannot deliver to the supplied address

If we cancel an order after payment has been taken, we will refund the affected amount to the original payment method.

Review your order carefully before submitting it. Contact us promptly if you need to request a change or cancellation. We cannot guarantee changes once fulfilment has begun.

6. Prices and payment

Unless stated otherwise:

• Prices are displayed in Australian dollars

• Prices include applicable GST where required

• Shipping charges are calculated and displayed during checkout

• International customers may be responsible for customs duties, import taxes or other charges imposed by their destination country

The price charged will be the price displayed when the order is submitted, subject to correction of an obvious error before the order is accepted.

Discounts and promotional offers may have separate conditions, including expiry dates, eligible products and usage limits. Where promotion-specific conditions conflict with these Terms, the promotion-specific conditions apply to that promotion.

You confirm that you are authorised to use the selected payment method and that the payment information supplied is accurate.

7. Shipping and delivery

Orders are shipped according to our Shipping Policy.

Dispatch and delivery times are estimates rather than guaranteed arrival dates. Delays can occur because of carriers, weather, customs, public holidays or other events outside our reasonable control.

We remain responsible for supplying the products ordered. Risk of loss or damage does not pass to you merely because we give the parcel to a delivery carrier.

You are responsible for providing a complete and accurate delivery address. Contact us immediately if you notice an error. We cannot guarantee that an address can be changed after dispatch.

Nothing in this section limits your rights when products are not delivered within an agreed or reasonable time.

8. Returns, refunds and consumer guarantees

Change-of-mind returns are governed by our Returns and Refund Policy.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

These rights apply independently of our voluntary 30-day change-of-mind policy.

9. Intellectual property

Unless otherwise stated, the website and its content—including the Nonnegotiable Flow name, logos, garment artwork, graphics, photographs, videos, text and website design—are owned by or licensed to Nonnegotiable Flow and are protected by applicable intellectual-property laws.

You may access and use the website for personal, non-commercial shopping purposes.

Without our prior written permission, you must not:

• Reproduce, distribute or commercially exploit our content

• Use our branding, logos or garment artwork

• Modify or create derivative works from our content

• Use our photographs or videos to advertise or sell other products

• Misrepresent yourself as being associated with Nonnegotiable Flow

Nothing in these Terms transfers ownership of our intellectual property to you.

10. Reviews, submissions and feedback

If you submit a product review, photograph, comment or other content to us, you confirm that:

• You created it or have permission to submit it

• It is accurate and not misleading

• It does not infringe another person’s rights

• It is not unlawful, abusive, defamatory or malicious

• Any payment, discount or incentive associated with the submission has been disclosed

You grant us a non-exclusive, worldwide and royalty-free licence to display, reproduce and use submitted content in connection with operating and promoting Nonnegotiable Flow.

We may remove content that reasonably appears unlawful, misleading, offensive or in breach of these Terms.

We will obtain any additional permission reasonably required before using identifiable customer photographs prominently in paid advertising.

11. Third-party services and links

Our website may use or link to third-party services, including payment providers, delivery carriers, social-media platforms and Shopify.

Third parties operate under their own terms and privacy policies. We are not responsible for unrelated third-party websites or services that we do not control.

This does not limit any responsibility we have for the products we sell or any obligation that cannot lawfully be excluded.

12. Shopify

Our store is hosted by Shopify. Shopify provides the ecommerce technology used to operate the website and process aspects of your interaction with the store.

Purchases made through this store are transactions between you and Nonnegotiable Flow. We, rather than Shopify, are responsible for the products sold through our store and for addressing customer enquiries about those purchases.

Your use of Shopify-supported functionality may also involve Shopify processing personal information as explained in our Privacy Policy and Shopify’s applicable privacy documentation.

14. Prohibited conduct

You must not use our website:

Termination of website or account access does not affect:

• Consumer rights that continue by law

The current version will be published on this page with its effective date. Material changes will apply prospectively and will not remove rights already acquired under an accepted order.

Continued use of the website after updated Terms take effect constitutes acceptance of the updated Terms for future use.

20. Severability

If part of these Terms is found to be unlawful or unenforceable, that part will be removed or limited to the minimum extent necessary. The remaining Terms will continue to operate.

21. Governing law

These Terms are governed by the laws of Australia and the applicable laws of the Australian state or territory in which Nonnegotiable Flow is registered.

Nothing in this section prevents a consumer from relying on mandatory rights available in their place of residence.
